International Software Copyright
International Software Agreement is a Matter of National Security
Is there one governing law concerning international software copyright? According to agreements by the World Trade Organization (WTO) and the Trade-Related Aspects of Intellectual Property Rights (TRIP) any software written has an automatic copyright. This is a pretty conclusive consensus as far as an international copyright goes. The short answer would have been yes, but this was so much more informative.
An international software copyright should not however be confused with a patent. Copyrights provide creators with the ability to prevent others from directly copying the code involved. A patent can actually limit the use of the software. Because of this, I'm sure you'll understand that patents are a hotly debated topic when it comes to software.
The biggest thing to know about international software copyright is that your code is essentially protected the moment you create it. This is, unless you have some kind of contract through your employer that all code created by your belongs to them (these cases have been known to happen and provide excellent incentives for employees to always read the fine print).
The problem that many companies are running into when it comes to enforcing international software copyright is that computers are not permanent fixtures in a company. Computers are rather disposable hardware when it comes to keeping up with evolving technologies and software needs to be updated when new computers are purchased. Rather than purchasing new copies of software when the computers are replaced companies are notorious for reusing old copies of the software. They are also famous for replacing 10 computers with the software installed with 40 new computers and installing the 10 copies of the software on all 40 computers. This is not in keeping with international software copyright. This is stealing and you'd be surprised at some of the good upstanding companies that do this on a regular basis.
There really are no major differences between traditional policies for American copyright and international software copyright which makes legal issues, troubles, and woes that much easier to deal with. By having a unified international front thee are ramifications and legal actions that can be taken around the world without going through a great deal of international red tape. If you think dealing with the American government is bad, you should see how much fun it is to deal with the American government and another government for a legal action.
The agreement between nations for international software copyright is probably one of the soundest possible decisions that can be made as military secrets of all governments have some degree of software in order to keep them operating. While it isn't quite as simplistic as stealing a computer program to unlock the defense secrets of a nation, having access to certain source codes could be problematic in the absolute best-case scenario. Keeping secrets isn't the only thing that makes this agreement so valuable, it is however, one of the most vital.
Perhaps one of the greatest things to come about as the result of the international agreement to protect and honor software copyright is the peace of mind that is available to software developers in America and other technologically advanced countries that their source code won't be allowed to be stolen and used against them at a later date by someone in a developing nation with cheap labor and other overhead costs that American corporations simply cannot compete with. This could be devastating to the economies of technological societies if it were allowed to happen and the agreement for an international software copyright prevents that from being allowed to occur.
Ghost Writer: Who Uses Them and Why (ghost writer) A ghost writer is someone who is hired to write for another person under their name. In most cases ghostwriters do the work while the hiring person gets the credit. The use of a ghost writer is huge business. People in virtually every aspect of life could use a ghost writer. A ghost writer will need the ability to become the person they are writing for. The writer has to be able to use their mannerisms, their words, and their way of speaking. The writing must read like they are coming from the person themselves. Being a ghost writer means that you give absolutely all rights to the credited author. You will need to decide if it is worth it for someone else to take credit for your work. There will be confidentiality clauses in your ghost writing contracts. They will state something to the effect of legal action will be against you if the writing is reproduced by you in any way shape or form. There are many reasons why a person would use a ghost writer. Celebrities and public figures use ghost writers to write their biographies and memoirs. Ghost writers are hired to make celebrities sound as interesting and compelling as possible. Their purpose is to pen the stories into best selling books. Motivational speakers may use ghost writers to write self help books. Just because they are great speakers does not mean they can pen the words on paper. Or they just may simply not have the time. There are many types of ghost writing opportunities available. Non fiction writing would be your biographies, autobiographies, how to books, and memoirs. A ghost writer’s role in non fiction could range from the very minimal to the most complex. They may be given an almost complete manuscript and asked to add some finishing touches. Or they may have to start at the bottom collecting research and following the project through until publication. Accomplished fiction writers may use ghost writers to carry on a series of books after the author has passed or to carry out the series while they work on new ventures. The Author may have an established pen name that they use a ghost writer for while they write under the real name. Ghost writers are often used for scripts and screen plays. They are hired to finish and polish the writings of the authors. High school and college students will hire ghost writers to write their entrance essays, thesis, and term papers. Although this may seem unethical, it is legal. The writing and selling of the paper is perfectly legal. It is when the student turns the paper in as his or her own writing that it turns into an illegal action. The political venue for ghost writers is to correspond to the letters that they receive. Official will review the letters before being sent. A political speech writer is often considered a ghost writer. But others will argue this since it is public knowledge that political officials do not write their own speeches. In order to succeed as a ghost writer you must have excellent writing skills and often be able to take on the personality of the credited author. You must also be a great sales person in order to sell your service and be able to prove that you are the best possible choice for them to use you in their endeavors. Making the decision if ghost writing is right for you may be a difficult one. It is often hard for writers to give up all rights to their work. Staying Computer Safe while Searching for Freebies on the Net Who doesn’t love the idea of getting something for nothing? Free stuff can bring a smile to anyone’s face, and the Internet is destination number one when you are looking for cash in on a few freebies. The downside of free stuff online is that if you aren’t careful, the free item could end up causing plenty of headaches and heartaches, not to mention a lot of cold, hard cash. If you want to score with free stuff online, make safety your number one priority by following these tips. First and foremost, treat your personal information like its cash. That might sound a little dramatic, but anyone who manages to steal your identity online is after one thing, and one thing only, your money and any addition money they can grab by cashing in on your credit. Protecting your name, address, credit card number, bank account number, phone number, social security number, and so on and so forth when you are registering for free offers is the first step to making sure you don’t get hustled when you’re just trying to enjoy a good freebie. That means that if you are asked for some personal information that you don’t feel comfortable handing out, let the freebie go. Likewise, make sure the site from which you are getting your free stuff has a privacy policy and that you know it, understand it, and can live with it. Speaking of that site that is handing out the free goods: just who are these people? If you were walking down the street and a shady looking person said they would give you a free DVD player if you followed them, chances are you would run the other way. Online, it is hard to tell the legitimate people from the people looking at you like a free lunch, but there are a few red flags you can look out for. Does the website look like it was thrown up in about 5 minutes, full of clip art and bad spelling? Is it hard to find information about where the website is registered, or where the business the website is supposedly promoting is registered? If the website purports to be affiliated with a certain brand you know, does it really look like it is, or does the logo look different/colors look off? If you can’t get a reasonable feel for who are dealing with online, don’t deal with them. Red flag number one? Asking for too much personal info should send you running. Another way to protect yourself is to build a virtual fortress around your computer. The net is filled with people who know how to walk right into your virtual home – your computer – and flip through everything you have on there, taking whatever they want. Many of these kinds of hackers draw you in by creating phony freebie websites. The way to keep them out is to keep your computer on lockdown. Make sure your firewall is stronger than you think it needs to be, and make sure it is always updated. Also, make sure you have antivirus software on the patrol for you and that you keep this software updated as well. Last but not least, keep those passwords in the vault, and make sure they are extra strong. No freebie website has any reason to ask you about the passwords for your accounts so don’t give them away – and don’t give them to anyone else online for that matter. Also, if you’re using your birthday or child’s name as password, don’t. Sure, it isn’t as easy to remember, but your password should be a random word and contain a collection of numbers and symbols as well. This will give you the extra layer of protection to make sure your online house is in order when you cash in on the freebies. |
