The Nuts and Bolts of Education Copyright Law
It is a wonderful thing that Education Copyright Law is available for educators. It isn’t only teachers that can take advantage of education copyright law. Students are also covered under education copyright law -- to a degree. Teachers are able to use copyrighted materials in their classroom and make copies of them. Students are also able to use copyrighted materials in school projects. The key to education copyright law is how often a teacher or student uses copyrighted material, in what way they are using it and how many copies they have of it. It is important that teachers and students do not cross the line of education copyright law or they could be in for some stiff penalties.
It helps many students and teachers to learn what exactly is not copyrighted. Any work that is in the public domain is not copyrighted and can be used in school and for school projects. Work that is not in the public domain is copyrighted and if you use it you should make sure you fall within the fair use or education copyright law regulations.
Many people do not know what exactly fair use copyright regulations are. When you are trying to see if you can use another’s words, you should keep a few things in mind. The answer to the following questions will help you gage whether you would be violating a copyright. First, are you transforming someone else’s work or are you copying it directly? If you are using another person’s work directly, for what purpose and how much of the original author’s work are you using? Many publishing companies have set rules on how much material they will allow to be quoted in other sources. Some of these ranges start at 100 words or less. However, there are truly no standards to go by, so be careful. You can not assume that keeping your copying fewer than 50 words will allow you to pass under the radar – especially if the original piece is hovering around 125 words itself! There is a greater amount of room to maneuver when it comes to technical writing. For instance, if you are writing a report on something that involves a lot of reporting from an expert, you would probably need to quote more of their work than you would a fiction novelist’s work. The fair use copyright law enables people to use portions of material that is copyrighted for the purposes of criticism or as commentary.
Individuals who are involved in the distance education field should take a look at the TEACH Act that was made into law in 2002. This Act clearly outlines the requirements that a university or school must be in compliance with when it comes to transmitting copyrighted works via the Internet. The TEACH Act allows students and teachers to transmit copyrighted works, but they must be within certain guidelines. If the school or university cannot meet these guidelines, the material that is being transmitted via the Internet needs to fall within the fair use copyright act – or the individuals involved need to have permission from the copyright owner. If you are an educator and you are using copyrighted material make sure it falls within the education copyright law.
Yes, Freebies are Real! If you tell someone that something is free, they immediately start looking for the catch. After all, the words of wisdom “there is no such thing as a free lunch” have usually been proven true for people time and again throughout life, and so a healthy cynicism towards free stuff usually springs up with good reason. If you are one of these skeptical types, however, you may be missing out on some really great stuff. The truth is that you CAN get free things that are really and truly free, and yes, actually worth having. You just have to know where to look. OK, here is where the caveat comes in. The definition of “free” often depends on the definition of “cost.” As any economist can tell you, cost really doesn’t only come down to how much money you have to hand over to get something. There are additional costs, like inconvenience and time spent doing something. And true, some freebies have these “non monetary” kinds of costs associated with them. You have to balance all of the costs with the value of the free stuff you are getting and decide if it is worth it to you. The two biggest costs associated with freebies? Time and convenience are at the top of the list. Time is a big factor in many free offers. Companies want a bit of your time in exchange for their free products. Indeed, some companies literally want hours of your time. Have you ever taken advantage of one of those “free weekend vacation” offers in which you received free accommodation in a beach house or condo for a weekend in exchange for suffering through a long presentation and intense sales pitch? For some people, they can handle the presentation and have no qualms about refusing to buy anything and the free vacation more than makes up for it. Other people would rather pay any price to avoid having to listen to one of these spiels. So, while these weekends are freebies, for some people, they cost too much. More often, a company wants your time in a less obvious way – they want you to spend time filling out forms. These forms may simply be your name, address and email address, or they may be very lengthy, quizzing you about buying habits and the like. The reason the companies want you to do these forms is often for market research, and they are more than happy to give you a freebie in exchange for this. Many people find the time spent filling out these forms will worth it to get a great free product. Convenience is the other cost involved with many freebies. Time and convenience go hand in hand in some cases – after all, it may not be especially convenient to fill out form after form simply because it is time consuming, but convenience takes another hit from freebies in the form of spam email. Often, signing up for a freebie can land you on a spam email list, and for some people, getting tons of spam is so inconvenient that they would rather pay full price. The truth about all of these costs of freebies is that the freebie is in the eye of the beholder. You have to decide what you are willing to put up with in order to get a free product. Once you know the limits to your freebie costs, than you can cash in on some really great products that don’t cost you a dime. When you spend five minutes filling out a form and get rewarded with a free DVD player that you have been wanting, you will realize that there are free things out there to be had. Tackling those Second and Third Interviews to Land that Job If you make it to a second or third interview, you are a serious candidate for the job. The key now is to narrow down the candidates. This moment is when you will determine if you get called with a job offer or receive a notice of rejection in the mail. Arm yourself with the proper tools and make an even bigger splash on the second and third interviews than you did at the first one. The first thing to remember when you are going into a second or third interview is what you said in the first interview. The interviewer will have notes from the first interview so you need to be ready to follow up on things you said initially. This is why it is important to be honest and realistic in the first interview. If you work hard to impress the interviewer and end up lying, you may not be able to recall they lies you told in the first interview. Eliminate this from being the case by telling the truth the first time around. Be armed with questions about the position and the company in generally. Search through information online about the company and get a feel for day-to-day operations. Type in the name of the company in Wikipedia and see what comes up. Many corporations are listed in this massive Internet encyclopedia and information about the company can be found there. Find out as much as you can about the company you are interviewing with. If you are interviewing with the same person the second or third time around, ask about their experience with the company. Questions like, “What is a typical day for you on the job?” or “How long have you been employed with the company?” can help to build a relationship with the interviewer. It also signals that you are comfortable with the interviewer. Not to mention, who does not like to talk about themselves? This is a great way to keep the interview moving on a positive note. Have plenty of questions about the position. Show that you have researched the job and are very confident that you are going to get it. The more inquiries you have about the position the more serious and interested you will seem. By the second or third interview, you will probably meet a number of different people. Shake hands firmly and look them in the eye when talking to them. If you are given a tour of the facilities, ask questions. Do not just let your tour guide point out areas without you taking an interest in them. Although it may seem like second and third interviews should be easier, do not let your guard down. Stay on your toes and be even more prepared than you were for the first interview. As the interview process moves on you will probably be meeting with the person that will be your direct boss or the director. Interviews with these figures may be much more difficult than the first interview which was probably with a human resource person. Be aware of this fact and have answers for those tough questions like, “What makes you the right candidate for this job?” Also be prepared for hypothetic situations that may take some spur of the moment problem solving. No matter what number interview you are on, there are some standard rules to follow. Take copies of your resume to your second and third interviews. Even though the interviewer may have a copy of your resume, you want to be armed with extras just in case there are other people in the department that would like copies. If you meet with different managers they may all ask for copies of your resume. Yes, they have copies, but they want to see if you are prepared. |
